1. Acceptance of Terms

By accessing or using SwiftList ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and SwiftList. Use of the Service by anyone under 18 is prohibited.

2. Description of Service

SwiftList is an AI-powered product image automation platform designed for makers, artisans, and small e-commerce sellers. The Service provides automated image processing workflows including background removal, AI upscaling, and lifestyle scene generation — all applied to product photographs.

SwiftList operates a Vibe Economy: a community marketplace where creators publish reusable styles called Vibes. When another seller applies your Vibe to their product image, you automatically earn Sparks — platform credits that extend your own workflow without additional cost.

SwiftList processes still images only. Video processing is not offered at this time.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

SwiftList reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period with notice where reasonably practicable.

4. Service Tiers

SwiftList offers the following service tiers:

• Explorer (Free): A no-cost tier with a limited monthly credit allocation. Explorer accounts can browse the Vibe Marketplace and apply community Vibes to their images. Explorer accounts do not earn Sparks.
• Paid Subscriptions: Monthly subscription plans that include a larger credit allocation, access to priority processing, and eligibility to earn Sparks when other sellers use your published Vibes.
• Credit Packs: One-time credit purchases available to all tiers. Credits purchased in a Credit Pack never expire and carry over month to month.

Tier features and pricing are described on the SwiftList pricing page and are subject to change with notice as described in Section 13.

5. Credits, Billing, and Refunds

5.1 Credits

SwiftList operates on a credit system. Each image processing job consumes a defined number of credits based on the workflow type. Credits have no cash value and are non-transferable between accounts.

Sparks are a special class of credits earned exclusively by paid subscription holders when other users apply their published Vibes. Sparks function identically to standard credits for processing jobs but cannot be cashed out or transferred.

If a processing job fails due to a platform error, the credits consumed by that job will be automatically refunded to your account within 24 hours.

5.2 Billing

Paid subscriptions are billed monthly on the anniversary of your subscription date. Credit Packs are charged at the time of purchase. All prices are in USD. SwiftList uses Stripe for payment processing; your payment information is held by Stripe and never stored on SwiftList servers.

Subscription credits reset at the start of each billing cycle. Unused subscription credits do not roll over. Credits from Credit Packs are consumed first and do not expire.

5.3 Refunds

14-Day Satisfaction Guarantee: If you are unsatisfied with a paid subscription, you may request a full refund within 14 days of your initial subscription purchase by contacting support. This guarantee applies to first-time subscriptions only and does not apply to subscription renewals or Credit Pack purchases.

Credit Packs and subscription renewals are non-refundable except where required by applicable law. Accounts terminated for violations of these Terms are not eligible for refunds.

6. Vibe Marketplace and Creator Economy

6.1 What Are Vibes

Vibes are reusable AI styles — combinations of lighting, setting, and atmosphere — that transform product photos into marketplace-ready images. Vibes may be created by SwiftList or by community members and published to the Vibe Marketplace for others to use.

6.2 Publishing Vibes

Any paid subscription holder may publish Vibes to the Marketplace. By publishing a Vibe, you grant SwiftList a non-exclusive, worldwide, royalty-free license to display, distribute, and process your Vibe for the purpose of operating the Marketplace. You retain ownership of your published Vibe.

You may unpublish your Vibe at any time. Unpublishing stops future use but does not affect images already processed using your Vibe.

6.3 Sparks Creator Earnings

When another user applies your published Vibe to a processing job, you automatically receive 2 Sparks credited to your account. This transfer occurs server-side at the time of job completion and requires no action on your part.

Sparks earning is a subscription-only feature. Explorer tier accounts can apply community Vibes but are not eligible to earn Sparks. Sparks have no monetary value, cannot be redeemed for cash, and cannot be transferred to another account.

SwiftList reserves the right to audit and correct Sparks balances if system errors or abuse are detected.

6.4 Marketplace Moderation

SwiftList reviews published Vibes for compliance with our content standards. We may remove any Vibe that violates these Terms, produces harmful or misleading outputs, or is otherwise inappropriate for the platform without prior notice. Repeated violations may result in account suspension.

7. Acceptable Use Policy

You agree not to use the Service to:

• Process, generate, or distribute illegal, harmful, or deceptive content
• Infringe the intellectual property rights of any third party
• Generate content that sexualizes minors in any form
• Impersonate another person, brand, or entity
• Automate account creation, circumvent rate limits, or use bots or scrapers
• Reverse-engineer, decompile, or extract the underlying models or algorithms
• Publish Vibes with prompts designed to produce harmful, deceptive, or misleading imagery
• Sell, sublicense, or resell access to the Service without written authorization

Violation of this policy may result in immediate account suspension and forfeiture of any remaining credits.

8. Intellectual Property

SwiftList and its licensors retain all rights to the platform, underlying AI models, software, and branding. Nothing in these Terms transfers ownership of SwiftList intellectual property to you.

Your content: You retain ownership of all images you upload. You grant SwiftList a limited, non-exclusive license to process your images solely to provide the Service.

Processed outputs: Images processed through SwiftList are yours to use for any lawful purpose, including commercial use on your e-commerce listings, provided those images do not infringe third-party rights. SwiftList does not claim ownership of your processed output.

9. AI-Generated Content

SwiftList uses third-party AI models to generate and transform images. You acknowledge that:

• AI-generated results may vary and are not guaranteed to meet any specific quality standard
• You are responsible for reviewing all AI outputs before using them in commercial listings or other public-facing contexts
• Some AI-generated images may inadvertently reproduce elements from training data; SwiftList does not warrant that outputs are free from third-party IP claims
• You must comply with the terms of any marketplace (e.g., Etsy, Amazon) regarding AI-generated imagery when listing products

SwiftList is not liable for any consequences arising from your use of AI-generated outputs in commercial contexts.

10. Data Retention

Uploaded and processed images are retained for 30 days from the date of processing, after which they are automatically deleted from SwiftList servers. It is your responsibility to download and store your processed images before this window expires.

Account data (profile, credit history, Vibe configurations) is retained for the duration of your account. Upon account deletion, your personal data will be removed within 30 days, except where retention is required by law.

11. Limitation of Liability

To the maximum extent permitted by law, SwiftList shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunity.

SwiftList's total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to SwiftList in the 12 months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Termination

You may close your account at any time through your account settings. Upon closure, your access to the Service ends immediately. Accounts in good standing that are closed voluntarily will receive pro-rata consideration for unused subscription credits at SwiftList's discretion.

SwiftList may suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform. Accounts terminated for cause will forfeit any remaining credits without refund.

Sections 8 (Intellectual Property), 9 (AI-Generated Content), 11 (Limitation of Liability), and any payment obligations survive termination.

13. Changes to Terms

SwiftList reserves the right to modify these Terms at any time. For material changes, we will provide at least 14 days' advance notice via email or in-app notification before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service before the effective date of the changes.
